Agreement to Terms

By accessing and using SAGEViBE, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use this service.

1. Introduction

1.1. "SAGEViBE" is a service that provides personal knowledge companions designed to learn from your life and help you with everyday tasks.

1.2. SAGEViBE is administered by SAGEVIBE, Inc. ("Company", "we", "our", and "us" shall be construed accordingly).

1.3. These Terms and Conditions set out the terms by which you may access and use SAGEViBE. By accessing and using SAGEViBE, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Service Description

SAGEViBE provides personal knowledge companions that learn from your life to deliver personalized assistance. Our service enables users to interact with AI companions through various interfaces including web and mobile applications.

You must carefully review information you receive from our Services. Because our Services rely on emerging AI technology and the inputs you provide, responses you receive may not be accurate or otherwise trustworthy. Outputs may be inaccurate and are only intended to be a starting point — they should be carefully evaluated for accuracy and appropriateness, particularly when making any decision that could impact your health or safety. Do not rely on outputs without fact-checking on your own first or consulting with a professional.

Our Services do not provide and are not intended to serve as a substitute for medical, legal, financial, or other professional advice.

3. License Grant

Subject to these Terms, we grant you a non-exclusive, non-transferable, revocable license to use SAGEViBE in accordance with these Terms. This license does not convey any title or ownership rights to the SAGEViBE platform itself.

4. Eligibility and User Responsibilities

You must be at least 18 years old to use SAGEViBE. By using our services, you represent that you are at least 18 years old.

You shall:

  • Provide accurate information when registering and maintain updated account information
  • Maintain the security of your account credentials and notify us immediately of any unauthorized access
  • Use the service in accordance with applicable laws and regulations
  • Respect the intellectual property rights of others
  • Use SAGEViBE solely for lawful purposes and in a manner that does not infringe the rights of others

5. Restrictions

You shall not:

  • Sell, lease, sublicense, or distribute SAGEViBE or your access credentials
  • Reverse engineer, decompile, or disassemble any part of SAGEViBE
  • Use SAGEViBE for any illegal purposes or exceed the scope granted herein
  • Engage in any activity that disrupts SAGEViBE, including hacking, spreading malware, or conducting fraudulent activities
  • Use SAGEViBE to harass, abuse, or harm others

6. Data Ownership and Privacy

6.1. Your Data: You retain full ownership of all personal data, content, and information you provide to your knowledge companions ("Your Data"). SAGEViBE does not claim ownership of Your Data.

6.2. Our Rights: While you own Your Data, you grant us a limited license to process, store, and use Your Data solely to provide and improve SAGEViBE services.

6.3. Privacy: We are committed to protecting your privacy. Our data handling practices are governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. Intellectual Property

7.1. The SAGEViBE service and its original content, features, and functionality are owned by SageVibe, Inc. and are protected by international copyright, trademark, and other intellectual property laws.

7.2. All rights, titles, and interests in SAGEViBE, including any modifications or improvements made during or after your use, belong exclusively to us.

8. Third-Party Services

8.1. SAGEViBE may integrate with or connect to third-party services, applications, or content.

8.2. We do not own, control, or endorse Third Party Services and assume no responsibility for their availability, functionality, or content.

8.3. Your use of Third Party Services is subject to their respective terms and conditions.

9. Disclaimers

9.1. SAGEViBE is provided "as is" and "as available" without warranties of any kind, whether express or implied.

9.2. We do not guarantee that SAGEViBE will meet your requirements, operate without interruption, be error-free, or be secure.

9.3. You acknowledge that you use SAGEViBE entirely at your own risk.

10. Limitation of Liability

10.1. To the fullest extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with SAGEViBE.

10.2. Our total liability to you for all claims arising from or relating to SAGEViBE shall not exceed the greater of $100 or the amount you paid us for SAGEViBE in the twelve (12) months preceding the claim.

11. Pricing and Access

11.1. SAGEViBE is currently available at no cost during our early access phase.

11.2. We reserve the right to introduce paid plans in the future. We will provide advance notice of any pricing changes, and your continued use of the service after such notice constitutes acceptance of the new terms.

12. Termination

12.1. We may terminate or suspend your account if you violate these Terms, if required by applicable law, or if we reasonably determine that your use poses a risk to other users or the integrity of the service. We will provide reasonable notice where practicable.

12.2. You may terminate your account at any time by following the procedures outlined in your account settings or by contacting us at contact@sagevibe.com.

12.3. Upon termination, your right to use SAGEViBE ceases immediately, but you retain ownership of Your Data.

13. Governing Law

13.1. These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of Delaware, without regard to conflict of law principles.

13.2. Any disputes arising from these Terms or your use of SAGEViBE shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
